By accessing or using pokok.soluna.my (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must not use the Service.

1. Description of the Service
Pokok is a web application that allows users to create, manage, and visualize family trees by entering family relationships and related information. Users may create personal family tree structures and store associated information such as names, dates, and images.
2. Eligibility
By using the Service, you represent that:
- You are at least 13 years old.
- You have the legal capacity to agree to these Terms.
- You will use the Service in compliance with all applicable laws and regulations.
3. User Accounts
To use certain features of the Service, users must create an account. When registering an account, you agree to:
- Provide accurate and complete information.
- Keep your login credentials secure.
- Be responsible for all activities that occur under your account.
To protect user accounts and maintain platform security, Pokok may record technical information associated with login sessions, including IP addresses and user agent information. This data may be used to detect suspicious activity, prevent unauthorized access, and maintain the integrity of the Service.
You must immediately notify us if you suspect unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms.
4. User Content
Users may upload or create content within the Service, including names of family members, birth and death dates, photographs, family relationships, and other family-related information.
You retain ownership of any content you submit. However, by submitting content to Pokok, you grant us a limited, non-exclusive, worldwide license to store, display, and process that content solely for the purpose of operating and providing the Service.
5. Responsibility for Shared Information
Because Pokok allows users to record information about family members, you agree that:
- You will only upload information that you have the right to share.
- You will respect the privacy of others.
- You will not upload content that violates any law or the rights of another person.
Pokok is not responsible for verifying the accuracy or legality of user-submitted family information.
6. Prohibited Uses
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Upload harmful, abusive, or unlawful content
- Attempt to gain unauthorized access to the Service or its systems
- Interfere with the proper operation of the platform
- Use automated systems (bots or scrapers) without permission
We reserve the right to remove content or suspend accounts that violate these rules.
7. Payments, Donations, and Marketplace
Pokok may accept voluntary donations to support the operation of the platform. Payments are processed via Chip In Asia. In the future, Pokok may offer digital products such as themes through a marketplace.
All purchases made through the platform are subject to payment provider policies, applicable laws, and availability of the digital content. Unless stated otherwise, purchases of digital products are non-refundable.
8. Third-Party Services
Pokok relies on third-party service providers to operate the platform, including:
- Vercel for hosting and infrastructure
- Resend for email delivery
- Google Analytics for analytics
- Turso for database services
These providers operate under their own terms and privacy policies.
9. Intellectual Property
The Pokok platform, including its design, code, branding, and functionality, is the intellectual property of ZA SOLUNA ENTERPRISE.
You may not copy, modify, reverse engineer, or redistribute any part of the Service without prior written permission.
10. Service Availability
We aim to provide a reliable service but do not guarantee uninterrupted availability. The Service may be temporarily unavailable due to maintenance, system upgrades, technical issues, or external service outages.
We are not liable for any interruption or loss of data caused by such events.
11. Account Termination
You may request account deletion at any time by contacting hello@soluna.my. Deletion requests will be processed within 30 days.
We reserve the right to suspend or terminate accounts if these Terms are violated, the Service is misused, or required by law.
12. Disclaimer of Warranties
The Service is provided “as is” and “as available”. We make no warranties regarding accuracy of user-generated data, availability of the Service, or suitability for any specific purpose.
Use of the Service is at your own risk.
13. Limitation of Liability
To the fullest extent permitted by law, ZA SOLUNA ENTERPRISE shall not be liable for loss of data, indirect or consequential damages, or damages resulting from use or inability to use the Service.
14. Changes to the Terms
We may update these Terms from time to time. When updates occur, the "Last Updated" date will be revised. Continued use of the Service after changes means you accept the updated Terms.
15. Governing Law
These Terms are governed by the laws of Malaysia. Any disputes arising from the use of the Service shall be resolved under Malaysian jurisdiction.
